TERMS AND CONDITIONS OF SALE

Article 1 - Scope of Application
These Terms and Conditions of Sale (the “Terms”) apply, without restriction or reservation, to all sales of online training courses and digital content offered by EMILIE LOVICOURT EI, a sole proprietorship registered under number 51833808200036, with its registered office located at 135 avenue Sainte-Marguerite – 06200 Nice, France.
Any order placed through the websites, sales pages, or platforms used by EMILIE LOVICOURT EI implies full and unconditional acceptance of these Terms by the customer.
The customer declares that they have the legal capacity to enter into a contract.
Article 2 - Nature of the Services
The services offered consist exclusively of online training courses and educational digital content, accessible remotely via the Internet.
No physical products are sold or delivered.
Article 3 - Orders
An order is considered final after:
validation of payment,
express acceptance of these Terms.
An order confirmation is sent by email to the address provided by the customer.
Article 4 - Prices
Prices are indicated in euros, all taxes included.
In accordance with Article 293 B of the French General Tax Code, VAT is not applicable.
EMILIE LOVICOURT EI reserves the right to modify its prices at any time.
The price applied is the one in effect at the time the order is placed.
Article 5 - Payment Terms
Payment is due immediately upon placing the order.
Payment may be made:
by credit or debit card (Visa, Mastercard) via a secure payment platform (in particular Stripe),
or via the PayPal payment service.
Transactions are processed by external and secure payment providers.
Banking or payment information is never stored or accessible by EMILIE LOVICOURT EI.
Any guarantee regarding the security of payment systems is the sole responsibility of the relevant payment providers (Stripe and PayPal).
Article 6 - Access to Digital Content
Training courses and digital content are accessible immediately after payment validation, subject to the proper functioning of technical systems.
Access is provided:
either through a personal online account,
or via a link or login credentials sent by email.
The customer is responsible for maintaining the confidentiality of their login details.
Any sharing of access or fraudulent use may result in suspension or termination of access.
Article 7 – Right of Withdrawal and Refund Policy
In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has a fourteen (14) day period from the date of purchase to exercise their right of withdrawal without providing any reason.
However, as the services consist of digital content delivered online with immediate access after payment, the customer expressly acknowledges that the performance of the service begins immediately after purchase.
If the customer wishes to exercise their right of withdrawal within the fourteen (14) day period, a refund may be granted only if the digital content has not been substantially accessed or consumed.
For the purposes of these Terms, the content is considered substantially accessed if more than ten percent (10%) of the total course material has been viewed or accessed.
If more than 10% of the course content has been accessed, the customer acknowledges that the service has been partially executed and no refund will be granted.
To request a refund within the eligible conditions, the customer must send a request by email to: contact@emilielovmua.com within the fourteen (14) day withdrawal period.
If the refund request is accepted, EMILIE LOVICOURT EI will reimburse the amount paid within fourteen (14) days from the validation of the request.
Access to the course and digital content will be revoked once the refund has been processed.
Article 8 - Intellectual Property
All content provided (videos, texts, educational materials, visuals, logos, trademarks, etc.) is protected by intellectual property laws and remains the exclusive property of EMILIE LOVICOURT EI.
Any reproduction, distribution, sharing, resale, or exploitation, in whole or in part, without prior written authorization is strictly prohibited and may result in legal action.
The training courses are intended for strictly personal use.
Article 9 - Liability
The training courses offered by EMILIE LOVICOURT EI are educational in nature.
They aim to transmit knowledge, methods, and techniques in the relevant field.
Results obtained after completing the training may vary from one individual to another and depend in particular on the customer’s personal involvement, practice, prior experience, and individual context.
The liability of EMILIE LOVICOURT EI cannot be engaged in the event of:
temporary interruption of the service for maintenance, updates, or technical improvements,
technical malfunctions beyond its control,
inappropriate or non-compliant use of the content by the customer.
Article 10 - Personal Data
The personal data collected is necessary for order processing and customer relationship management.
In accordance with the General Data Protection Regulation (GDPR), the customer has the right to access, rectify, object to, and delete their personal data, which may be exercised by contacting EMILIE LOVICOURT EI at the following address: contact@emilielovmua.com
Newsletters and commercial communications are sent only with the customer’s consent.
The customer may unsubscribe at any time via the link provided for this purpose.
No personal data is transferred to third parties without consent.
Article 11 - Governing Law and Disputes
These Terms are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority.
Failing this, the French courts shall have exclusive jurisdiction.
